Iran, where a US-Israeli strike killed the Supreme Leader in February and where the strikes have resumed after the June ceasefire broke down. Ukraine, where the American commitment continues to expand through emergency supplemental appropriations that no Congress has framed as a declaration of war. And Taiwan, which the American press treats as an imminent flashpoint even though the US intelligence community’s own March 2026 Annual Threat Assessment concluded that China has no fixed timeline for invasion.

Three theaters. Three “inevitabilities.” Each framed for the American citizen the same way: this is coming; there is nothing to deliberate; the only question is how well we prepare.

The framing is doing specific work. Once a war feels inevitable, deliberation ends. Once deliberation ends, the friction the framers wrote into the war power — the requirement that Congress declare, the two-year cap on army appropriations, the biennial House that must be re-elected before a war can continue — becomes procedural theater around a decision already made.

The Peace Racket voice has a name for the technique. “Inevitable” is how deliberation gets ended.

Here is what makes this specific moment worth naming: the strategic community that is supposed to be preparing for war is itself openly warning that the current allocation of American attention is exactly wrong.

The Pentagon’s own analysis

This is not restraint-school analysis. It is not Quincy Institute or Cato Institute or any voice easily dismissed as peace-adjacent. The warnings are coming from the mainstream defense establishment.

The Heritage Foundation, in its 2025 report The Prioritization Imperative, wrote plainly: “If the United States goes to war against Russia, it will likely expend many capabilities required to deter or defeat Chinese aggression, making war in the Indo-Pacific more likely and increasing the likelihood of Chinese forces defeating the United States.”

CSIS, the Center for Strategic and International Studies — as centrist and bipartisan a defense think tank as exists in Washington — has published multiple reports arguing that “China’s power and Asia’s wealth make Asia the priority” and that “China must remain the Pentagon’s top priority.”

Foreign Policy magazine, in analysis dating back to 2022 and updated since, has warned that “a move by Russia in the Baltics would create a favorable opening for China to move against Taiwan, translating into a de facto second-mover advantage that would be very tempting for Beijing to exploit.”

The pattern the sources describe is clear: American strategic doctrine, on paper, prioritizes the Indo-Pacific first and Europe second. But the political and media allocation of American attention runs the opposite direction — toward Ukraine, toward Iran, toward the theaters where American war-making capacity is being consumed while the theater the Pentagon calls priority number one is left to Taiwan’s smaller resources and the wavering confidence in American commitment.

Russia and China have every reason to prefer exactly this allocation. Each benefits from the American attention being spent on the other’s theater. The two-front trap is not a theory; it is a strategic possibility both adversaries are documented to have thought about.

Three theaters, actual status

Worth naming plainly, because the “inevitability” framings obscure the actual facts.

Iran is at active war with the United States and Israel as of February 2026. The war has produced significant casualties and a fractured attempt at ceasefire. Congress has not declared war on Iran. The authority under which American forces are engaged has been assembled from the 2001 and 2002 AUMFs — texts written for different conflicts, in different circumstances, twenty-plus years ago, by legislators mostly no longer in office. Volume One’s Chapter Twenty-Eight walks through this atrophy in detail.

Ukraine is not a war the United States is directly fighting, but it is a war the United States is paying for at a scale that has now reached approximately $185 billion in cumulative assistance since February 2022 — roughly $131 billion in security assistance and another $44 billion in economic and humanitarian support, per the Congressional Research Service and the Special Inspector General for Operation Atlantic Resolve. The financing has run through emergency supplemental appropriations — the same off-budget, debt-financed architecture Chapter Twenty-Eight identifies as the modern racket’s most consequential fiscal innovation. No revenue measure has been passed to pay for the aid in the year it is being spent.

The war itself has now lasted longer than World War I. On June 10, 2026, the Russia-Ukraine war reached 1,568 days — the exact duration of the First World War, from July 1914 to November 1918. Vladimir Putin ordered his troops across the border in February 2022. Four and a half years later, the fighting continues, the American commitment continues with it, and neither a Congressional declaration of war nor a revenue measure has been passed to define or pay for what the country is doing.

Woodrow Wilson, once, called the First World War “the war to end all wars.” That naming has echoed with brutal irony for a century. The war that we have now been financing longer than that war still has no name in American law — no declaration, no war-tax measure, no defined objective the citizens have been asked to endorse.

Taiwan is not at war. According to the US Intelligence Community’s own March 2026 Annual Threat Assessment, China does not currently plan a 2027 invasion and has no fixed timeline for unification. China continues to build military capability, and recent drills suggest planning for scenarios that include nuclear use. But the “imminent invasion” framing that circulates in the American press does not match the assessment of the American intelligence services. What is happening is that Taiwan is extending conscription and increasing defense spending in a moment when Taiwanese confidence in American support has, per multiple sources, waned.

The framework the framers wrote

Volume One’s Chapter Twenty-Eight names five friction mechanisms the framers built into the war power: declared wars, AUMF sunsets, war taxes, the draft question, procurement reform. Each was written into the document because the framers had read Polybius on the late Roman Republic and knew what happens to a republic that stops finding war hard.

Each of the three current theaters would, under the framers’ architecture, require its own declaration, its own tax, its own explicit authorization in the current Congress by current members answerable to current voters. None of them has. Each is being conducted or prepared for under authorities constructed elsewhere, at other times, for other purposes.

The framer’s principle applies to every theater, not just the domestic conscription question. The friction was written into the document because the framers knew what a polity looked like when its wars had ceased to be the citizens’ choice. That polity, in the framers’ reading of Rome, was no longer a republic.

The citizen response

Not panic. Not fatalism. Notice.

Notice which framings you are being sold. Notice when the word “inevitable” appears, and ask what it is doing in the sentence. Notice which theater the American press is telling you to fear, and compare it to what the American strategic community says is the actual priority.

Ask which vote authorized each commitment. Ask what the tradeoffs actually are. Ask who has read the Heritage Foundation report, the CSIS analysis, the Foreign Policy warnings — because the defense establishment has said, in plain English, that the current allocation of American attention is strategic malpractice.

Call your Representative. Call your Senators. Ask which theater they have voted to authorize, and which they have voted to fund. Ask what the war-power vote would look like if it came to their chamber tomorrow. Ask them to name their position before the momentum builds that makes the vote feel inevitable.

“Inevitable” is how deliberation gets ended. Deliberation is what the framers built the friction to protect.

That sentence is worth writing plainly, because a great deal of the language traveling right now would have you believe otherwise. Automatic Selective Service registration for men aged eighteen to twenty-six takes effect this December. That is administrative. It is not conscription.

Registration is being placed on a list. Induction is being called to serve. A list is not a call.

The distinction matters, and it matters for a reason older than any of the current headlines. The framers wrote friction into the war power on purpose. Volume One’s Chapter Twenty-Eight walks through the architecture — Article One, Section Eight; the biennial House; the two-year cap on army appropriations; the requirement that Congress declare war. Five brakes. Written into the document because the framers had read Polybius on the late Roman Republic and knew what a republic looked like when it stopped finding war hard.

The Selective Service System has a list. It has always had a list. What is changing this December is the mechanism of getting men onto that list — from active registration at eighteen to silent enrollment via federal data. What is not changing is the constitutional step that would move a name from on the list to in uniform. That step still requires a vote of Congress. The Military Selective Service Act says so. National emergency powers do not change that. No living American has been called to serve without a specific vote of Congress since 1973.

The pattern, of course, is not confined to the United States. Germany’s new Military Service Law took effect in January — mandatory questionnaires, compulsory medical exams, foreign travel approval for men seventeen to forty-five. France launched a ten-month voluntary program this summer. Poland is targeting one hundred thousand participants a year. Croatia reinstated mandatory service. The UK is studying it. Russia passed legislation clearing the way for criminal-record enlistment.

The drums are beating. Not just in Washington. In Berlin. In Warsaw. In Paris. In Zagreb. In Moscow.

This is the pattern Peace Racket exists to name — and to distinguish from the framings being sold to citizens. Structural preparation across the North Atlantic and its adversaries is observable. Structural preparation is not authorization. It is not induction. It is not mobilization. It is polities keeping options open that they have not yet chosen to exercise.

Now here is the timing insight worth carrying:

If a draft bill ever reaches a President’s desk in the United States, it will most likely be signed. This is not a prediction about any specific occupant. It is a structural observation — every President who wants war-making capacity has reason to preserve the draft option. The check point that matters, the point where citizens still have voice, is upstream of that signature. It is in the House. It is in the Senate. And it is now — before any bill has been introduced, before any hearing has been scheduled, before the momentum builds that makes the vote feel inevitable.

If you are young and opposed to a future draft — or you love someone who is — this is the moment to act. Vote in the midterms. Call your Representative. Call your Senators. Show up at town halls. Participate in peaceful protest, if that is your form.

Those are your Constitutional rights. But here is the truth about a right: if you don’t exercise it, you don’t have it.

The framework the framers wrote is only friction if citizens exercise it. Outside the process, there is no leverage. There is only running.

A note before we begin. This missive was scheduled for Thursday. Publishing it today, because the invisible hand of peace is worth naming before it slips through ours.

Adam Smith wrote about the invisible hand three times.

Only three.

Once in an early essay on astronomy. Once in The Theory of Moral Sentiments, his 1759 book on ethics. Once in The Wealth of Nations, 1776. The single passage from Wealth is the one economics students have to memorize; the other two, where Smith is actually working out what he means, most readers have never seen.

Smith’s argument, compressed into a sentence: individual actors pursuing their own local interests, in the aggregate and under the right structural conditions, produce a collective outcome none of them intended and most of them could not have designed. The baker bakes because he wants to earn a living. The butcher butchers for the same reason. The brewer brews. None of them wakes up meaning to feed the town. The town gets fed anyway.

That is the invisible hand. Distributed self-interest, structurally coordinated, producing a public good.

Notice what the invisible hand is not.

It is not magic. It is not providence. It is not the free market absolving anyone of responsibility. Smith himself, in Moral Sentiments, spent hundreds of pages on the other half of the argument — the sympathies, the ethical judgments, the reciprocal obligations that structure human societies alongside self-interest. The invisible hand works in a moral universe Smith took seriously. When Milton Friedman’s students, two centuries later, turned the invisible hand into a slogan for market absolutism, they were reading Smith’s phrase without reading Smith.

There is another invisible hand. Nobody named it. Adam Smith did not write about it.

It has been operating for as long as human beings have organized themselves into polities, and it operates the way Smith’s hand operates — distributed, structural, invisible until it stops.

It is peace.

Peace is not the absence of war. That is what peace looks like from a war reporter’s desk. Peace, seen from inside, is a working condition. It is the shopkeeper opening at seven. The child walking to school without an escort. The judge applying the law her predecessor applied. The plumber replacing the pipe. The neighbor showing up for the neighbor’s funeral. The diplomat returning the phone call. The soldier who does not have to fire the weapon that day, and the general who does not have to give the order.

None of those actors wakes up meaning to keep the peace. They are running their businesses, raising their children, doing their jobs, tending to their own. The polity gets kept anyway.

That is the other invisible hand.

You do not notice it while it is operating. That is the point of the metaphor. The grandparent who lived through one war lived inside the invisible hand during the long stretches between. So did the parent who lived through another. So did the children who never learned what either war was for. Each of them lived, mostly, inside the working condition — and mostly, without remarking on it, because the working condition is what allowed them to think about other things.

We only notice the invisible hand when it stops.

The current historical moment is a moment where people around the world are noticing.

Smedley Butler, whose pamphlet gave this project its name, saw the racket at its most brazen — American Marines deployed as debt collectors for United Fruit and City Bank across the early twentieth century. Butler wrote War Is A Racket in 1935 because he could see, from where he sat, that the invisible hand had stopped operating in his own polity — that the conditions of peace that ordinary Americans depended on were being drained by a specific apparatus with specific beneficiaries. He named it. He said what he saw.

Ninety years later, the racket’s still running. And so is the answer.

The answer is not to give peace a chance. The answer is not to hope somebody keeps the peace. The answer is the invisible hand — restored, honored, recognized for what it is. It is the shopkeeper, the judge, the neighbor, the general, the child walking to school. It is you. It is the person reading this sentence. It is the person you will see today whose ordinary work is a piece of the working condition none of us can afford to lose.

Time to notice it before it stops.

In January 1661, a small group of English Christians who called themselves the Religious Society of Friends — and whom their enemies called Quakers — delivered a document to the newly restored King Charles II. It was a declaration of their refusal to bear arms. Not against him. Not against anyone.

The document was drafted primarily by George Fox, the itinerant preacher who had founded the movement roughly a decade earlier, and by Richard Hubberthorne, one of Fox’s closest collaborators. It was addressed to the king because Charles had just returned from exile and was suspicious of any religious sect that might have supported the Cromwellian Commonwealth against his father. The Friends wanted to make their position unmistakable: they had not fought for Cromwell. They would not fight for Charles. They would not fight in any cause, for any end, under any pretense.

The Declaration is one of the founding documents of what is now called the peace testimony — the Society of Friends’ three-hundred-and-sixty-five-year commitment to refuse participation in war. It has never been rescinded.

The cost of the commitment was immediate.

Between 1660 and 1690 in England, approximately fifteen thousand Quakers were imprisoned for various refusals — refusal to bear arms, refusal to swear oaths, refusal to remove their hats before magistrates, refusal to pay tithes to the Church of England. Approximately four hundred and fifty died in prison from disease, cold, and overcrowding. Fox himself was imprisoned eight times.

In colonial Massachusetts, the persecution was worse. Between 1659 and 1661, four Quakers were hanged on Boston Common for the crime of returning to the colony after banishment: William Robinson, Marmaduke Stevenson, Mary Dyer, and William Leddra. Mary Dyer walked back to Boston knowing she would be executed. Her last recorded words: “My life avails me not in comparison to the liberty of the truth.”

The commitment continued.

George Fox himself visited the American colonies in 1672 and 1673, preaching in Barbados, Jamaica, and along the Atlantic seaboard from Rhode Island to North Carolina. In Maryland he addressed mixed audiences of English settlers and members of local Native American communities — a practice that would shape William Penn's approach to Pennsylvania nine years later.

William Penn, an English Quaker of aristocratic background, received a royal charter in 1681 for a colony that would test whether a peace-witness community could actually govern territory. He named it Pennsylvania — Penn’s Woods — for his father, and he called the founding project the Holy Experiment. Penn negotiated peace treaties with the Lenape rather than seizing land; those treaties held for approximately seventy years, longer than any other Anglo-Indigenous peace agreement of the colonial period.

John Woolman, a New Jersey Quaker tailor and traveling minister, published Some Considerations on the Keeping of Negroes in 1754 — one of the earliest sustained Christian anti-slavery arguments in America. Woolman personally traveled from Quaker meeting to Quaker meeting persuading Friends to free their enslaved workers. By 1776, most American Quakers had done so. The Society of Friends became the first religious body in the Anglophone world to require its members to renounce slaveholding.

Levi Coffin and Thomas Garrett, both Quakers, ran the two most important Underground Railroad stations of the antebellum period. Coffin in Indiana and Garrett in Delaware collectively helped an estimated five thousand people escape slavery. Both were prosecuted repeatedly; both continued the work anyway.

Bayard Rustin, born to a Quaker household in West Chester, Pennsylvania, in 1912, applied the Quaker peace testimony to the American civil rights movement. He introduced Martin Luther King Jr. to Gandhian nonviolence in 1956. He organized the 1963 March on Washington in eight weeks. He was gay in a movement that had not yet come to terms with that fact, and he paid a professional cost for it. He held the line anyway.

The institutional expression of the peace testimony arrived on April 30, 1917.

Three weeks after the United States entered the First World War — a war the Society of Friends had been publicly opposing — Quaker leaders in Philadelphia founded the American Friends Service Committee to give conscientious objectors constructive alternatives to military service. Members were sent to France to rebuild villages destroyed by war, to Russia during the famine of 1921–1923, to Germany to distribute food after the Armistice.

The AFSC continued that work through the interwar period, both World Wars, the postwar refugee crises, Vietnam, and every American war since.

On December 10, 1947 — Nobel Peace Prize day — the AFSC and its British counterpart, the Friends Service Council, were jointly awarded the Nobel Peace Prize “for their work for peace and international understanding.” Henry Cadbury accepted for the AFSC. He said: “Not by might, nor by power, but by spirit.”

That was the Quaker peace testimony delivered from the podium of the Norwegian Nobel Committee, two years after the Trinity test, in the year the Doomsday Clock was set for the first time.

The line of witness the volume the newsletter accompanies is tracking often runs through individuals — Butler, Douglass, Bates, King. The Quaker peace testimony is what happens when a community holds the line across three and a half centuries. It is one of the few sustained institutional peace-witness traditions in the modern West. It is religious in its origin but not sectarian in its application: AFSC has served, and been served by, people of every faith and none.

The Peace Racket claim that peace is a working condition requiring deliberate maintenance is not a new claim. The Quakers have been maintaining it since 1660.

Any evening is a good evening to sit with a tradition that has held the line for three hundred and sixty-five years.

On Monday of last week, Day 15 of this newsletter named a mechanism most modern American citizens no longer possess a working word for: sortition. Selection by lot. The Athenian invention Cleisthenes made structural in 508 BCE. The kleroterion at the Epigraphic Museum in Athens is the physical artifact.

Today’s missive is about the word itself.

Two hundred and fourteen years ago, on February 11, 1812, Governor Elbridge Gerry of Massachusetts signed into law a redistricting bill for the state Senate. Gerry was seventy years old, a signer of the Declaration of Independence, a signer of the Articles of Confederation, and a former delegate to the Constitutional Convention who had refused to sign the Constitution because he thought it needed a Bill of Rights. He was fifteen months from being sworn in as Vice President of the United States under James Madison. He would die in office in Washington on November 23, 1814.

The redistricting bill Gerry signed drew a state Senate district in Essex County in the shape of a long, twisting serpentine boundary. The bizarre outline was drawn to concentrate the state’s Federalist voters into as few districts as possible, so that the Democratic-Republican party — Gerry’s party — could win a majority of Senate seats with a minority of votes.

On March 26, 1812, the Federalist-aligned Boston Gazette published a cartoon by an unnamed artist — long attributed to the engraver Elkanah Tisdale, though the attribution is not certain — that depicted the district with wings, claws, and a fanged head. The caption named it: The Gerry-Mander.

The word entered the American language within weeks.

Two centuries later, most American citizens can define it in a sentence. Politicians manipulate district boundaries to advantage their own party at the expense of representative fairness. It is a specific practice with a specific name. When the practice appears, citizens have a word ready. They can point at it. They can critique it. They can demand reform.

This is what a word does.

Sortition is older by twenty-three hundred years.

The word comes from the Latin sortitio — the drawing of lots. It named a specific democratic mechanism used routinely in ancient Athens, in Renaissance Venice for parts of the doge selection process, in Renaissance Florence for a range of magistracies, and — with modifications — in modern jury selection systems around the world.

The word largely dropped out of everyday political vocabulary from the eighteenth century onward. The rise of elected representative government in the United States, in France after 1789, and across Europe through the nineteenth century displaced sortition as a live political idea. By 1900, most Americans, French, Britons, and Germans would have needed a definition. By 2000, most still would.

The mechanism did not disappear because it stopped working. The mechanism disappeared from the menu because the word disappeared from the vocabulary.

You cannot propose what you cannot name.

This is the Peace Racket move applied to civic language.

Butler in 1935 gave a generation the word racket to describe what was being done to it. Douglass in 1852 gave the honest counter-record its first American vocabulary by naming the Fourth of July as slaveholder-holiday. Erasmus in 1517 gave the Renaissance the phrase Querela Pacis — the Complaint of Peace — and turned peace itself into a speaker. Each was doing what the Boston Gazette cartoonist did on March 26, 1812. Each was putting a word into circulation so that the practice attached to it — good or bad — could be named, discussed, and either critiqued or demanded.

Vocabulary is not decoration on political thought. Vocabulary is the toolkit political thought works with.

Gerrymandering entered the toolkit in 1812 and stayed. Because Americans had the word, they could name the practice when they saw it. They could pass laws against it. Twelve states now use nonpartisan redistricting commissions of one kind or another. The word made the reform possible. Not sufficient — but possible.

Sortition left the toolkit somewhere around the American and French Revolutions. Modern citizens who have never encountered the word cannot ask their state legislature to try a citizen assembly, because they have no word to attach to what they are asking for. The Irish Citizens’ Assembly of 2016 to 2018 was possible because someone in Ireland still had the word. The French Convention Citoyenne pour le Climat of 2019 to 2020 was possible because someone in France still had the word. The British Columbia Citizens’ Assembly on Electoral Reform of 2004 was possible because someone in British Columbia still had the word.

The word is not the mechanism. The word is the door.

Putting sortition back into ordinary American civic vocabulary is a small structural act. It is the first act. Once the word is in circulation, the mechanism is available for citizens to propose to their city councils, their state legislatures, their governors, their neighbors. Some polities will try it. Some already have.

The volume the newsletter accompanies makes the same move a hundred different ways. Butler’s racket, Bates’s flaws beside beauty, Newton’s naming of the slave trade in his own former voice, Marshall’s equal protection argued live before the Supreme Court in 1952 and 1953 — each is a word or phrase put into circulation so that the practice attached to it could enter the room of things a citizen can name, propose, or demand.

Any night is a good night to add a word to your vocabulary that a citizen a century ago did not have.

Sortition. You have it now. Do with it what you will.

Ninety years ago yesterday, in Spanish Morocco, a group of Nationalist military officers launched an uprising against the elected Republican government of Spain. Ninety years ago today, the uprising reached the Peninsula. What had been a Moroccan military mutiny on July 17, 1936 became a Spanish war on July 18.

General Francisco Franco flew from the Canary Islands to Morocco to take command of the Army of Africa. General Emilio Mola launched the northern rising. Within days approximately half of Spain’s territory had fallen under Nationalist control. The other half — including Madrid, Barcelona, and the Basque and Catalan regions — held for the Republic.

The Republic had been proclaimed only five years earlier, on April 14, 1931, after Spain’s King Alfonso XIII went into exile following municipal elections that revealed how thoroughly the country had turned toward republican government. The intervening five years had been years of reform, resistance, and increasingly bitter polarization. The February 1936 elections had returned a Popular Front coalition of Republicans, Socialists, and Communists. The Nationalist coup was the military’s response to that election.

The war lasted almost three years. It ended on April 1, 1939 with a Nationalist victory. Franco ruled Spain until his death on November 20, 1975.

The Spanish Civil War is the twentieth century’s rehearsal for the Second World War.

Nazi Germany and Fascist Italy supplied Franco’s Nationalists with aircraft, tanks, tank crews, air crews, artillery, and personnel — most consequentially the Condor Legion of the Luftwaffe, which arrived in November 1936 and remained until the end of the war. The Soviet Union supplied the Republicans with aircraft, tanks, advisors, and NKVD political officers. Mexico supplied arms and refuge. The Western democracies — Britain, France, the United States — signed a Non-Intervention Agreement in August 1936 that pretended the war was Spain’s domestic affair while Germany and Italy actively supplied Franco. The pretense was known to be a pretense at the time.

The war saw the first industrial-scale terror bombing of European civilians. On April 26, 1937, the Condor Legion bombed the Basque market town of Guernica during a market-day afternoon. Approximately 250 to 1,600 civilians were killed — the exact figure is contested, but the political and moral impact was not. Pablo Picasso, working in Paris, painted his mural response between May and June 1937 and exhibited it at the Paris International Exposition that summer.

The world was watching. Some of the world was writing it down.

The international volunteers came.

Approximately thirty-five thousand foreign volunteers, from over fifty countries, joined the International Brigades organized under Comintern auspices to fight for the Spanish Republic. The Abraham Lincoln Brigade of American volunteers numbered approximately twenty-eight hundred. Roughly seven hundred and fifty of them died in Spain. They fought at Jarama, Brunete, Belchite, Teruel, and the Ebro. They were disbanded and repatriated in September 1938 after the Republican government asked all foreign volunteers to withdraw in a final attempt to force German and Italian withdrawal from the Nationalist side. The withdrawal did not force a matching withdrawal. The Republic fell six months later.

The line of witness ran deep.

George Orwell — Eric Arthur Blair — arrived in Barcelona in December 1936, initially to write newspaper articles. He joined the POUM (Partido Obrero de Unificación Marxista) militia almost immediately. He was shot through the throat by a Nationalist sniper at the front near Huesca in May 1937. He recovered. He returned to Barcelona to find the POUM being purged by Communist forces as suspected Trotskyists. He and his wife fled Spain. He wrote Homage to Catalonia, published in 1938. It is one of the truest books ever written about war by a person who fought in it.

Ernest Hemingway arrived as a correspondent for the North American Newspaper Alliance in March 1937. He wrote dispatches. He collected material. He returned to Cuba in 1938 and wrote For Whom the Bell Tolls, published in 1940. Robert Jordan, the American dynamiter of the Spanish Republican side, was fiction — but the moral geography of the novel was recorded from the ground.

Robert Capa photographed the war from September 1936 onward. His photograph The Falling Soldier — a Republican militiaman at the moment of being shot, September 5, 1936, near Cerro Muriano — became one of the most reproduced war photographs of the twentieth century. Whether the photograph is authentically what it claims to be has been debated since the 1970s. What is not debated is that Capa was there.

Simone Weil, the French philosopher, joined an anarchist militia briefly in August 1936. She was injured by boiling oil in a cooking accident and returned to France. She wrote about the experience in Letter to Georges Bernanos (1938). What she saw, she said, was that the war on the Republican side was also being conducted with cruelty. The honest counter-record within the honest counter-record.

Federico García Lorca, the Spanish poet, was murdered by Nationalist forces near Granada on approximately August 19, 1936. He was thirty-eight years old. One of the first cultural casualties.

The Republic lost.

That is the fact the peace-witness tradition has to hold honestly. Franco won. Fascism prevailed on the peninsula for thirty-six years. The volunteers who died at Jarama and Brunete died in a losing cause. The witnesses who wrote it down did not save the Republic they wrote about.

But they wrote it down.

Orwell’s Homage to Catalonia has never gone out of print. Hemingway’s For Whom the Bell Tolls is still assigned. Picasso’s Guernica hangs at the Museo Reina Sofía in Madrid, where any citizen of the country Franco once ruled can walk in for free on Sunday afternoons and look at what a fascist air force did to a Basque market town in April 1937. The Republic lost. The witnesses did not.

And the volume the newsletter accompanies makes an honest counter-record within its own argument. Peace Racket names peace as a working condition and war as the racket that most often produces itself. But the Spanish Republican defense against Franco’s coup was not a racket. Some wars are not. Some wars are the ones Butler set aside in War Is a Racket — defense of homes, defense of the constitutional inheritance a people has chosen for itself.

The Republic lost. The distinction survives.

The most dangerous woman in America.

In 1917, a fifty-seven-year-old woman from Chicago was informed that she was, in the estimation of the United States military intelligence apparatus and several prominent patriotic organizations, the most dangerous woman in America.

Her name was Laura Jane Addams. She had been born in Cedarville, Illinois, on September 6, 1860, the daughter of a state senator who had been a personal friend of Abraham Lincoln. She had graduated from Rockford Female Seminary in 1881. In 1889 she had co-founded Hull House on Chicago’s Near West Side — one of the first and most influential settlement houses in the United States, providing education, childcare, health services, and civic training to the immigrant families of Chicago’s Nineteenth Ward.

In the intervening twenty-eight years she had co-founded the National Association for the Advancement of Colored People (1909, charter member), served as vice president of the National American Woman Suffrage Association, published Twenty Years at Hull-House (1910, and immediately a classic of American memoir), chaired the Woman’s Peace Party (1915), presided over the International Congress of Women at The Hague (April 1915) that gathered 1,136 women from twelve nations to advocate for a negotiated end to the war then raging, and traveled to the capitals of Europe carrying peace proposals to heads of state.

The label was for the peace work.

In April 1917, the United States entered the First World War. Addams did not.

She continued to advocate publicly for a negotiated settlement. She continued to speak against the mobilization. She continued to publish. The New York Times denounced her. The Daughters of the American Revolution — which had made her an honorary member in 1900 — expelled her. The Bureau of Investigation, predecessor to the FBI, opened a file on her that would eventually run to hundreds of pages. Military Intelligence Division agents attended her lectures and recorded her speeches. Various patriotic organizations circulated the most dangerous woman label until it acquired a life of its own.

For most of the decade and a half that followed, she was pushed out of the American mainstream. Speaking invitations that had been routine before 1917 stopped arriving. Foundations that had funded Hull House became cautious. She continued the work anyway. In 1919 she co-founded the Women’s International League for Peace and Freedom in Zurich. She served as its president from 1919 until 1929. She wrote Peace and Bread in Time of War (1922) about the moral and material cost of the pacifist witness during the war she had opposed. The book sold modestly. It has been in print, one way or another, ever since.

The rehabilitation was gradual.

By the mid-1920s, some of the WWI-era hysteria had subsided. Universities began inviting her again. Her writings on settlement work were reissued. She was, quietly at first and then less quietly, restored to the position of respected American public figure she had held before 1917.

On December 10, 1931, in Oslo, the Nobel Committee awarded the Nobel Peace Prize jointly to Jane Addams and Nicholas Murray Butler. Addams was seventy-one years old. She was recovering from surgery. She was too ill to travel to Oslo to receive the award in person. Her acceptance was read by a representative. She donated the prize money to the Women’s International League for Peace and Freedom.

She was the first American woman to receive the Nobel Peace Prize.

The country that had labeled her the most dangerous woman in America in 1917 was, in 1931, standing in the reflected honor of the Nobel Committee’s recognition of exactly what it had denounced her for.

She lived three and a half more years. She died on May 21, 1935, of colon cancer, in Chicago, three days after surgery. She was seventy-four.

This is what it can cost to be a peace witness during a war a witness’s country has chosen. The apparatus does not always kill. Sometimes it simply de-platforms and quietly waits.

Addams paid the cost of the fifteen-year exile because she believed, and continued to believe when her belief was expensive, that the moral case for peace does not acquire an asterisk when a country goes to war. What is wrong in Berlin is wrong in Washington. What is wrong in Paris is wrong in London. Killing is killing. The witness who says so during peacetime is respected. The witness who says so during wartime is denounced. Same witness. Same claim. Different apparatus response.

The line of witness the volume the newsletter accompanies is tracking includes the witnesses who paid the reputational cost. Butler paid a related cost when War Is a Racket was published in 1935 — the same year Addams died — and effectively ended his participation in the mainstream American military-political establishment he had spent thirty-three years serving. Douglass paid the cost of being called the moral scold of the Fourth of July for a decade after 1852. King paid a heavier cost in 1968 for exactly the same reason Addams paid it in 1917 — for insisting that the peace argument does not stop at the water’s edge.

Any of the witnesses could have made a career move. None of them did.

Today is the eighty-first anniversary of the moment humanity crossed a threshold that cannot be uncrossed.

At 5:29:45 in the morning, Mountain War Time, on July 16, 1945, in the Jornada del Muerto desert of central New Mexico — the Journey of the Dead Man, a name given to the region by Spanish colonial travelers in the sixteenth century for the difficulty of the crossing — the first nuclear weapon was detonated. The device, nicknamed the Gadget, was a plutonium implosion bomb. Its yield was approximately twenty-one kilotons of TNT equivalent. The fireball at the moment of detonation was hotter than the surface of the sun for a fraction of a second. The mushroom cloud rose to thirty-eight thousand feet. Sand at ground zero fused into a mildly radioactive green glass afterward called trinitite. Small fragments of it are still occasionally found by rockhounds in the New Mexico desert, though possession is now regulated.

The test was code-named Trinity. J. Robert Oppenheimer, scientific director of the Manhattan Project, chose the name after a John Donne sonnet — Batter my heart, three-person’d God — for reasons he later found difficult to explain even to himself.

Oppenheimer watched the detonation from base camp ten miles away. In an NBC television interview twenty years later, he recalled the passage from the Bhagavad Gita that he had thought of at the moment: Now I am become Death, the destroyer of worlds.

Kenneth Bainbridge, Trinity’s test director, standing beside him, said in plainer English: Now we are all sons of bitches.

Everything Peace Racket argues about apparatus, consent, honest counter-record, and the line of witness sharpens under a mushroom cloud.

Nuclear weapons are the apparatus at its purest. They are a machinery of mass killing whose maintenance requires the continuous consent of citizens who have almost no way to inspect what is being maintained on their behalf. Butler’s 1935 argument about the racket is small next to the Trinity fact of 1945. War as racket was one polity’s apparatus extracting from that polity’s people. Nuclear weapons are the same structural claim scaled to the level of the species.

The line of witness responded almost immediately.

August 2, 1939. Six years before Trinity. Albert Einstein and Leo Szilárd sign a letter to President Roosevelt warning that Germany may be pursuing an atomic weapon. Roosevelt authorizes preliminary research. The Manhattan Project follows.

July 17, 1945. One day after Trinity. Leo Szilárd circulates a petition among Manhattan Project scientists urging President Truman not to use the bomb against Japanese civilians without a demonstration and an opportunity for surrender. Seventy scientists sign. The petition is intercepted by General Groves and does not reach Truman before Hiroshima on August 6 or Nagasaki on August 9.

October 1945. Oppenheimer meets with President Truman at the White House. He says, quietly: “Mr. President, I feel I have blood on my hands.” Truman is offended. He later tells Dean Acheson never to bring “that cry-baby scientist” into his office again.

July 9, 1955. Bertrand Russell issues a manifesto co-signed by Albert Einstein a week before Einstein’s death. It is signed by eleven scientists, nine of them Nobel laureates. Its closing sentence: Remember your humanity, and forget the rest.

1957 onward. The Pugwash Conferences on Science and World Affairs, growing directly from the Russell-Einstein Manifesto, become the venue for scientific dialogue across the Cold War divide. Awarded the Nobel Peace Prize in 1995.

1947 forward. The Bulletin of the Atomic Scientists introduces the Doomsday Clock. Its current setting, announced January 2026, is eighty-nine seconds to midnight — the closest to the metaphorical global catastrophe in the Clock’s seventy-nine-year history.

Each of these witnesses did what Butler did. They named the racket from inside the apparatus that had produced it. Einstein signed the letter that helped start the Manhattan Project and then spent the last week of his life signing the manifesto that would define the postwar peace movement. Szilárd conceived the possibility of the chain reaction in 1933 and then petitioned against its use in 1945. Oppenheimer built the Gadget at Los Alamos and then testified for the rest of his life against the arms race he had made possible.

By the peak of the Cold War in the mid-1980s, the United States and the Soviet Union together held approximately seventy thousand nuclear warheads. The United Kingdom, France, and China had joined the club. Israel had become undeclared. India, Pakistan, and eventually North Korea followed. Nine nuclear-armed states exist today, holding roughly twelve thousand warheads between them — down significantly from the 1986 peak through arms control and post-Cold War drawdowns, but sufficient to end civilization many times over. And the trajectory is now upward again: American modernization, Russian new-system fielding, Chinese buildup toward parity.

The doctrine that governed the system was old. The Roman writer Vegetius put it in the fourth century CE: Si vis pacem, para bellum — if you would have peace, prepare for war. The nuclear version acquired its specific name at the Pentagon in the early 1960s under Secretary Robert McNamara: Mutually Assured Destruction. The strategic logic was that no state would initiate a nuclear war it could not survive, and that therefore massive retaliatory capacity was itself the guarantor of Great Power peace. The acronym was MAD, and its architects were not unaware of the joke.

The MAD peace held. From 1945 to today, the Great Powers have not fought each other directly. That is a genuine achievement. It is also an eighty-one-year exercise in maintaining peace through the constant threat of civilizational annihilation. Peace as working condition — the argument the volume the newsletter accompanies makes — is not the same as peace as MAD equilibrium. One is peace as the medium in which ordinary human life flourishes. The other is peace as the fear that stays the hand at the button. Both prevent war. Only one is peace in any register the human witnesses of the last three thousand years would have recognized.

The Trinity site is still there. Ground zero at the Jornada del Muerto. It is opened to the public twice a year — the first Saturdays of April and October — for a few hours. A modest obelisk marks the spot where the Gadget was detonated. It is quiet. The Jornada is quiet. The desert has almost, but not entirely, taken it back.

The line of witness continues, present tense. Each generation inherits what the previous generation did not manage to un-build. The Gadget is now a museum artifact. The apparatus it inaugurated is not.

Any night is a good night to remember what was crossed at Alamogordo eighty-one years ago, and what has been maintained since.

Dulce bellum inexpertis. War is sweet to those who have not tried it.

In December 1517, a small book was printed in Basel by Johann Froben. It was written in Latin. It was seventy-odd pages long. Its title was Querela Pacis undique gentium eiectae profligataeque — The Complaint of Peace, Driven from All Nations and Suppressed. Its author was Desiderius Erasmus of Rotterdam, at that moment the most famous scholar in Europe.

The book did something no European book had quite done before.

It gave Peace a voice.

The device is simple and startling. Peace is not the subject of the essay. Peace is not being explained. Peace is the speaker. She enters the text as a person, in the first-person feminine, and begins to describe her own exile. She has been driven from the courts of princes, from the councils of clergy, from the halls of universities, from the sanctuaries of monasteries, from the marriage beds of Christians, from the very churches that carry her name in their liturgy. She wanders. She finds no home.

In paraphrase-condensation of the opening pages: I, Peace, once counted among the highest goods, now find no place to rest. Those who cry my name in prayer drive me out in practice. Those who preach me on Sunday commission the arms on Monday. If I were being expelled for your welfare, I could bear the exile. But I am driven out to your ruin as much as mine.

She names, over the course of the little book, the specific machinery of her expulsion: princely ambition disguised as national interest; clerical faction disguised as theology; scholarly rivalry disguised as truth; the merchant’s calculation that a modest war profitable to a few is preferable to a lasting peace profitable to all.

The argument is not that peace is fragile. The argument is that peace is actively expelled by those who would benefit from her absence. The apparatus of war is producing what Erasmus, five hundred and nine years ago, already recognized as the racket.

Erasmus was not naive.

He wrote Querela Pacis between two catastrophic phases of European war. The Italian Wars had raged intermittently from 1494 to 1516, killing perhaps a million people across the peninsula. The Wars of Religion — the Schmalkalden, the French Wars of Religion, the Thirty Years’ War — were about to begin. Erasmus could see, with a scholar’s clarity, that the pause was temporary.

He had written Dulce bellum inexpertis — War is Sweet to Those Who Have Not Tried It — as an entry in his Adages in 1515, arguing that the horror of war is invisible to the young and to the councilors who have never seen it. He had written Institutio principis christiani — The Education of a Christian Prince — in 1516, addressed to the young Charles V, arguing that a Christian ruler’s first obligation is to preserve his people from the machinery of war. He had corresponded with Thomas More, whose Utopia appeared the same year, on the same theme. Querela Pacis was the completion of the argument. Peace, having been argued for as policy and taught as princely duty, was finally given her own voice to speak.

Six weeks before Querela Pacis was printed in Basel, on October 31, 1517, an Augustinian friar named Martin Luther posted ninety-five theses on the door of the Castle Church in Wittenberg. Erasmus and his printer did not yet know what those theses would mean. But within a decade, Erasmus’s dream of a unified Christian Europe capable of choosing peace over war would be structurally impossible. The apparatus that produced the Wars of Religion was already assembling itself while his little book about peace was being bound.

The literary device survived its historical moment.

Peace as speaker is a move the line of witness continues to make.

Butler in 1935 named the racket by naming what the apparatus produces on the far end — corpses and profits and ruined polities. Erasmus in 1517 named the racket by giving Peace a voice with which she could describe her own exile. Same insight. Different rhetorical register. Both witnesses looking at the same medium and asking, why do those who cry my name drive me out?

The humanist variant of the line of witness is Erasmus. He is not a chapter in Volume II — the volume follows a different set of witnesses forward — but he stands as the literary grandfather of the whole tradition. Any project that names peace as a person to be honored rather than a condition to be preserved is a project descended from the small book Froben printed in Basel in December 1517.

The book is available. Multiple modern English translations of Querela Pacis remain in print. It is short. It can be read in one long evening.

Peace still speaks, present tense, when someone opens the book. She still describes her exile. She still asks the question about the distance between what is prayed and what is procured.

Any evening is a good evening to sit with her.

Today is the two hundred and thirty-seventh anniversary of the storming of the Bastille.

On July 14, 1789, a crowd estimated at one thousand Parisians surrounded the medieval fortress on the eastern edge of the city. The Bastille had been built in the 1370s as a defensive gate. By 1789 it had become a state prison, holding — on the day it was stormed — seven prisoners: four forgers, two men judged insane, and one aristocrat. The building itself mattered more than its inhabitants. It was the visible symbol of arbitrary royal authority: the lettre de cachet king could imprison any subject without trial, and the Bastille was where the imprisoned went.

The crowd had come first to demand gunpowder. They had marched from the Hôtel des Invalides earlier that morning, where they had seized muskets. What they needed to make the muskets useful was black powder, which was known to be stored at the Bastille. Negotiations with the fortress’s governor, the Marquis de Launay, broke down. A skirmish began. Reinforcements arrived on the crowd’s side. By late afternoon the fortress had fallen. De Launay was killed in the street. The heads of de Launay and the prévôt des marchands were paraded on pikes through the city.

That is the specific event.

The Bastille was demolished stone by stone in the months that followed. King Louis XVI recorded in his diary on July 14, 1789: “Rien.” — “Nothing.”

What the summer of 1789 was actually producing structurally was something the king did not yet see.

On June 17, 1789, the Third Estate — the commoners’ delegation to the Estates-General convened at Versailles to address the financial crisis — had declared itself the National Assembly. On June 20, locked out of their meeting hall, they had gathered on a nearby tennis court and sworn what became known as the Tennis Court Oath: not to disband until France had a written constitution. On July 9, they renamed themselves the National Constituent Assembly. On July 11, the king dismissed the finance minister Jacques Necker, who was widely trusted as a reformer. The dismissal was interpreted as a signal that royal forces were preparing to disperse the Assembly.

That is the context in which the crowd went looking for gunpowder on July 14.

Six weeks after the Bastille fell, on August 26, 1789, the National Constituent Assembly adopted the Déclaration des droits de l’homme et du citoyen — the Declaration of the Rights of Man and of the Citizen. Seventeen articles. Roughly nine hundred words in the original French. It affirmed liberty, property, security, resistance to oppression, equality before the law, freedom of speech, freedom of the press, presumption of innocence, and the sovereignty of the nation. It became one of the foundational documents of modern human-rights thought.

The Marquis de Lafayette — Gilbert du Motier — drafted an early version of the Declaration with Thomas Jefferson’s counsel in Paris. Lafayette had fought under Washington in the American Revolution. He had returned to France believing what he had helped defend in Massachusetts and Virginia might now be built at home. On the morning of July 15, 1789, the day after the Bastille fell, Lafayette was named commander of the newly formed National Guard.

Two revolutions. One life.

The honest counter-record.

The same revolution that produced the Declaration also produced, four years later, the Reign of Terror. From approximately September 1793 to July 1794, the Committee of Public Safety authorized the execution by guillotine of an estimated seventeen thousand people, with tens of thousands more killed in provincial repressions — most notoriously the drownings at Nantes and the mass shootings at Lyon.

The apparatus that had liberated the Bastille four years earlier had, through the sequence of ideological hardening, external war, internal factional purge, and revolutionary paranoia, produced a machinery of state killing that operated with the same efficiency it had once used against arbitrary royal authority.

Maximilien Robespierre — architect of the Committee of Public Safety, chief public defender of the Terror as necessary revolutionary virtue — was himself arrested on July 27, 1794 and executed on July 28. The apparatus consumed its own most dedicated custodian.

Lafayette, by then, was in an Austrian prison. He had fled France in August 1792 to avoid arrest by the Jacobins; his party was captured; he was held in captivity by the Austrians and Prussians for five years. He was freed in 1797 at Napoleon’s insistence. He returned to France. He lived through the Consulate, the Empire, the Bourbon Restoration, the July Revolution of 1830, and the Orleanist monarchy. He died on May 20, 1834, and was buried at the Picpus Cemetery in Paris.

American soil, brought to Paris in a small quantity, was scattered on his grave.

The American flag has flown continuously at Lafayette’s grave at Picpus Cemetery since his burial — through the Third Republic, both World Wars, the Nazi occupation, the Fifth Republic, and every French summer since. On July 4, 1917, the day American troops first paraded through Paris in the First World War, the American commander Charles Stanton stood at Lafayette’s grave and said, in the phrase attributed to him: Lafayette, we are here.

Peace is a working condition. Revolutions are not automatically its friend. A revolution can produce a Declaration of the Rights of Man and a Committee of Public Safety inside the same five-year window. What survives the revolution is what its successors continue to maintain.

The Declaration of 1789 continues, present tense, to be part of the French constitutional order. It is cited by French courts. It is taught in French schools. It is the founding structural document Lafayette went home to help write after helping build the country he first fought for.

Any day is a good day to sit with the Declaration.

Bastille Day is a particularly good one.

Yesterday’s missive named the individual’s refusal to feed the machine. Today’s missive names one of the structural mechanisms by which citizens can construct legitimate collective decision in the first place.

In 508 BCE, in Athens, Cleisthenes reorganized the political structure of the polis around one of the most consequential democratic innovations in human history: selection by lot. The Athenian Boule — the council of five hundred that set the agenda for the Assembly, prepared legislation, and administered the polis on a day-to-day basis — was staffed by citizens chosen randomly from the demes of Attica. Farmers, potters, sailors, olive-oil merchants. Each served one year. Rotation was continuous.

Ancient Athens did not invent voting. Ancient Athens invented the deliberate use of random selection to prevent the wealthy and the rhetorically gifted from concentrating political power at the expense of everyone else.

The technology of the selection was a small stone machine called the kleroterion, which we named on Day 10 of this newsletter. Citizen identity tokens were slotted into columns; the machine’s random selection mechanism produced the day’s jurors, councilors, and magistrates. Surviving kleroteria are held at the Epigraphic Museum and the Ancient Agora Museum in Athens. You can visit them.

Here is how the machine actually worked. Each Athenian citizen carried an identity ticket — a pinakion, a small bronze plate engraved with his name, his father’s name, and his tribe. On mornings when officials were to be selected, citizens seeking to serve came to the Agora and handed their pinakia to the archon of their tribe. The tickets were inserted into the columns of the kleroterion, organized by tribe — a row across the machine held one citizen from each of the ten tribes at once. A magistrate then poured black and white balls into a bronze funnel attached to the machine. The balls emerged one at a time from a channel at the base. Each ball corresponded to a horizontal row of pinakia. A white ball meant the citizens in that row were selected for the day. A black ball meant they went home. The whole procedure happened in public. Any citizen could stand and watch. Any manipulation would have had to happen in front of everyone.

Aristotle observed the political principle in Politics Book Four, around 335 BCE:

It is thought to be democratic that offices should be filled by lot, and oligarchic that they should be elective.

The observation is structural. Elections tend to select for the qualities that win elections: money, name recognition, media access, rhetorical skill, tribal loyalty. Sortition selects for something else — for the demographic microcosm of the polity itself. A citizen assembly chosen by lot is, statistically, a representative sample of the population that convened it. Its starting opinions are the opinions the population holds. Its deliberation, over months, is the deliberation the population would produce if given the same time, the same experts, and the same room.

That is the innovation Cleisthenes made in 508 BCE. That is the innovation the modern world has been rediscovering in the twenty-first century.

The recent record.

Ireland — Citizens’ Assembly on the Eighth Amendment. October 2016 to April 2018. Ninety-nine ordinary Irish citizens, randomly selected to be broadly representative of the population, plus a chair. Met on weekends across eighteen months. Received expert testimony from doctors, lawyers, and ethicists spanning the range of Irish opinion. Deliberated. Voted. Recommended, by significant majority, that the constitutional prohibition on abortion be repealed and replaced with a legislative framework. The Irish government held the referendum. On May 25, 2018 the country voted yes, sixty-six point four percent to thirty-three point six percent. Ireland’s current legal framework is a framework proposed not by a party platform but by ninety-nine randomly selected citizens who sat and read and listened and thought.

France — Convention Citoyenne pour le Climat. October 2019 to June 2020. One hundred and fifty French citizens randomly selected. Deliberated across nine months on how France should reduce greenhouse gas emissions by at least forty percent by 2030. Produced one hundred and forty-nine specific proposals. Some were adopted; some modified; some rejected. What the process demonstrated is that ordinary French citizens, given the time and the expert briefing, were willing to propose more ambitious climate action than the elected government was willing to enact.

British Columbia — Citizens’ Assembly on Electoral Reform. 2004. One hundred and sixty randomly selected British Columbians met for eleven months and recommended a single transferable vote system. The 2005 referendum received fifty-seven point seven percent support — short of the sixty-percent threshold the government had set. The recommendation did not pass into law. What remains, twenty-two years later, is the record: fifty-seven point seven percent of a provincial electorate supported a proposal produced by one hundred and sixty of their fellow citizens sitting in a room.

Iceland — National Assembly and Constitutional Council. 2010 to 2011. Nine hundred and fifty randomly selected Icelanders met to propose the values that should guide a new constitution. A twenty-five-member Constitutional Council then drafted the document.

The pattern across all of these: give ordinary citizens the time, the expert briefing, and the room to deliberate — and they produce decisions of a quality the electoral machinery struggles to produce on its own.

This is the Peace Racket move applied to the polity itself.

Peace is a working condition that requires maintenance. Maintenance requires legitimate collective decision-making. Electoral democracy is one mechanism, and it has produced enormous benefits over the centuries. It has also produced predictable pathologies: fundraising as the price of entry, polarization as the strategy of victory, gridlock as the frequent result. Sortition-based citizen assemblies are a complementary mechanism — not a replacement — that add to the polity’s structural capacity for good decisions on questions the electoral machinery cannot easily handle.

Peace is the deliberation ordinary citizens are capable of when they are given the conditions to deliberate.

The invitation is not to abolish elections. The invitation is to widen the toolkit of legitimate collective decision-making so that peace has more surfaces on which to be maintained.

Every citizen already qualifies for the room. The room is not reserved for the credentialed or the wealthy or the loud. The room, when it is convened, is filled by the same statistical process that decides who sits on the jury when someone in your county is on trial.

The room the Athenians built is available.

Any citizen can begin to ask that their polity convene it.

Today is the two hundred and ninth anniversary of the birth of Henry David Thoreau.

He was born in Concord, Massachusetts, on July 12, 1817. He lived forty-four years. He died of tuberculosis in the same house on Main Street in Concord on May 6, 1862, having just seen the country he loved enter the second year of the war he had spent his adult life warning would come.

Concord is a small town. Even now, at almost two hundred thousand people in the greater Boston metropolitan area, the Concord village center is walkable. The town green is a few hundred yards from the Old North Bridge, where the Revolutionary War began on April 19, 1775. The Thoreau house, the Emerson house, and the Alcott house are all within a half-mile of each other. The jail where the story we are telling today happened was on Main Street.

In July 1846, Henry Thoreau was walking into Concord village to pick up a shoe from the cobbler. On the way he was stopped by Sam Staples, the town constable and jailer, who reminded him that he had not paid his Massachusetts poll tax for six years. Thoreau said he did not intend to pay it. Staples said if that was the case he would have to arrest him. Thoreau said he understood.

Staples arrested him and walked him to the town jail.

Thoreau spent one night there. The next morning someone paid the tax on his behalf — probably his Aunt Maria, over his stated objection — and Staples released him. The story was that Thoreau was so angry about being paid out that he refused for a while to leave the cell.

The Mexican-American War had been declared two months earlier, on May 13, 1846. The tax Thoreau refused to pay funded, in part, that war. He considered the war unjust — an aggressive war of territorial expansion, driven substantially by the political interests of slaveholders seeking new slave states. He was not going to voluntarily contribute money to it.

That is the story.

What came out of the night in the Concord jail was the essay.

Thoreau delivered it first as a lecture at the Concord Lyceum on January 26, 1848, under the title The Rights and Duties of the Individual in Relation to Government. Elizabeth Peabody published it in May 1849 in the one and only issue of her journal Aesthetic Papers under the title Resistance to Civil Government. Thoreau’s sister Sophia included it in the posthumous 1866 collection A Yankee in Canada, with Anti-Slavery and Reform Papers, where an unknown editor gave it the title by which the world now knows it: Civil Disobedience.

The essay’s central claim is structural.

Government is a machine. Its motion is powered by the consent of the governed. When the machine is producing injustice — when the state, in Thoreau’s specific case, is prosecuting an unjust war — the individual citizen has a moral obligation to withhold consent. Not to petition the machine, not to vote for a different operator of the machine, not to write letters to the newspaper about the machine, but to stop feeding the machine. The tax collector arrives. The citizen declines. The machine slows.

Let your life be a counter friction to stop the machine.

This is the individual-consent argument in its most compressed American form. It is what Peace Racket, Volume I, calls the invisible-hand-of-peace argument approached from the individual scale: the countless small acts of consent that continuously power the apparatus can also be countless small acts of refusal, and when enough of them coincide, the apparatus slows.

The line of witness carried Thoreau’s essay onto two additional continents.

Mohandas Gandhi read Civil Disobedience while imprisoned in South Africa in the early years of his satyagraha — truth-force — campaign. He later called the essay his “textbook” on non-violent resistance. The strategic architecture of the 1930 Salt March, the 1942 Quit India Movement, and the Indian independence movement broadly is Thoreau’s essay elaborated at national scale.

Martin Luther King Jr. — Chapter Thirteen of the volume this newsletter accompanies — read Civil Disobedience as a student at Morehouse College. He wrote in Stride Toward Freedom in 1958 that reading it convinced him “that non-cooperation with evil is as much a moral obligation as is cooperation with good.” The Montgomery bus boycott of 1955 to 1956, the Birmingham campaign of 1963, and the strategic-nonviolent architecture of the American civil rights movement stand structurally downstream of the Concord jail cell.

Concord to Ahmedabad to Montgomery. Three cities. Three witnesses. One continuous philosophical inheritance.

Butler in 1935 named the racket from inside the apparatus that produced it.

Thoreau in 1849 named the individual’s refusal to feed the apparatus from outside it.

Both arrived at the same insight from different angles. The apparatus continues only as long as citizens continue to consent to it. Every ordinary act of consent — every tax paid, every vote cast, every enlistment signed, every cheer at the parade — is one small pulse of energy into the machine. And every ordinary act of refusal is one small pulse of the counter friction.

The apparatus is patient. The apparatus is old. But so is the refusal.

The refusal is available today, tomorrow, and next week. It has always been available. It is available to you.

Any night is a good night to sit with Thoreau.

Today is the thirty-first anniversary of the day the Srebrenica genocide began.

On the morning of July 11, 1995, forces of the Army of Republika Srpska — the Bosnian Serb military, commanded by General Ratko Mladić — entered the town of Srebrenica in eastern Bosnia and Herzegovina. Srebrenica had been designated a United Nations Safe Area by Security Council Resolution 819 on April 16, 1993, and reaffirmed by Resolution 824 on May 6, 1993. It was to be shielded from armed attack, monitored by UN peacekeepers, and defended if necessary by NATO close air support.

Approximately four hundred lightly armed Dutch peacekeepers — Dutchbat III, part of the United Nations Protection Force — were stationed at the compound in Potočari, on the outskirts of the town. Their commanding officer was Lieutenant Colonel Thom Karremans of the Royal Netherlands Army. The rules of engagement under which they operated permitted the use of force only in self-defense.

Over the following twelve days, from July 11 to approximately July 22, 1995, Bosnian Serb forces separated the Bosniak Muslim population by sex. Women, children, and the elderly were bused out to Bosniak-held territory. Men and boys, ages roughly twelve to seventy-seven, were transported to warehouses, schools, and open fields and systematically executed.

Approximately eight thousand three hundred and seventy-two Bosniak Muslim men and boys were killed.

The mass graves were bulldozed, disinterred, and reburied at secondary sites in the weeks that followed to conceal the scale.

The International Criminal Tribunal for the former Yugoslavia — the ICTY, established by UN Security Council Resolution 827 on May 25, 1993 — ruled in the Prosecutor v. Krstić judgment of August 2, 2001, and its appellate confirmation of April 19, 2004, that what occurred at Srebrenica constituted genocide within the meaning of the 1948 Genocide Convention.

The International Court of Justice — the ICJ, the principal judicial organ of the United Nations — ruled in Bosnia and Herzegovina v. Serbia and Montenegro on February 26, 2007, that the Srebrenica massacres constituted genocide.

Radovan Karadžić, President of Republika Srpska during the war, was arrested on July 21, 2008, convicted on March 24, 2016, and given a life sentence on appeal on March 20, 2019.

Ratko Mladić was arrested on May 26, 2011, convicted on November 22, 2017, and had his conviction upheld on June 8, 2021, with a life sentence imposed.

On May 23, 2024, the UN General Assembly adopted Resolution 78/282 designating July 11 as the International Day of Reflection and Commemoration of the 1995 Genocide in Srebrenica.

The record is complete. The judgments are final. The names of the dead are known.

What the record also carries is the honest counter-record from inside the institution that failed.

Four years after the massacre, Secretary-General Kofi Annan submitted to the UN General Assembly a report titled The Fall of Srebrenica. He commissioned it. He signed it. He did not soften it. The report is the sentence in the pull quote above and it is the structural sentence this project holds today: the United Nations, the report said, tried to apply the rules of peacekeeping in a situation where no peace remained to keep.

The apparatus was on the ground. The blue helmets were there. The Security Council resolutions had been adopted. The Safe Area had been declared. The rules of engagement had been written.

The apparatus without the political will to use it was worse than the absence of the apparatus. The apparatus signaled to the population of Srebrenica that they would be protected. They were not.

This is what the volume the newsletter accompanies is tracking, in a register that is heavier today than it is most days.

Peace is a working condition. Peace requires maintenance. Peace requires that the structures deployed to protect it be given the mandate, the force, and the political will to do what they are deployed to do. Peacekeeping is not a photograph of blue helmets. Peacekeeping is the willingness of the international community to make the peacekeepers effective. When the willingness is absent, the structure becomes what Srebrenica shows it can become: a stage set for the massacre to occur under a peacekeeping flag.

That is the honest counter-record inside the peace-witness argument. It has to be held alongside the argument, or the argument is not honest.

The line of witness continues.

The Mothers of Srebrenica — Majke Srebrenice — organized in 1996 to insist on the accounting. The International Commission on Missing Persons has, over the intervening decades, forensically identified the remains of more than seven thousand of the dead through DNA analysis, allowing families to bury sons and fathers and brothers whose graves had been bulldozed twice. The names are read aloud each July 11 at the Srebrenica-Potočari Memorial and Cemetery, where the identified dead are buried in rows of white stelae under the mountains they died beneath.

Every July 11, the reading of names continues.

Tonight is a good night to hear them.

“How’s the water?”

— the parable of the fish

There is a parable — old, folk, more than one tradition claims it — that goes something like this.

Two young fish are swimming along and they happen to meet an older fish swimming the other way, who nods at them and says, Morning, boys. How’s the water?

The two young fish swim on for a while. Eventually one of them looks over at the other and says, What the hell is water?

That is the parable. It is a simple parable and it does most of its work by not explaining itself.

What the fish do not ask is the medium they are in.

In 1776, in An Inquiry into the Nature and Causes of the Wealth of Nations, Adam Smith named a similar phenomenon in economics. He observed that the individual, “by pursuing his own interest, frequently promotes that of the society more effectually than when he really intends to promote it.” He called this the invisible hand.

It was, he said, a pattern that emerged from countless individual actions without any of the actors intending the pattern itself.

Smith is Chapter Nine of the volume this newsletter accompanies.

The Invisible Hand is not a conspiracy. It is not a design. It is not a person or a committee or a policy. It is a structural pattern that emerges from ordinary human behavior operating under certain conditions. The market participants do not see it. They see prices, contracts, transactions. The hand is not visible from inside the market.

This project takes Smith’s insight and applies it to peace.

Peace is the medium the fish do not see.

Peace is not the absence of war. Peace is the water. It is the working condition — the maintained set of structural arrangements — inside of which ordinary human life becomes possible. Children go to school. Farmers plant crops. Trade moves across borders. Marriages are performed. Books are written. Elections are held. Grandparents die at home surrounded by their families rather than in mass graves.

When peace is working, the people inside it do not see it. They see school, harvest, trade, weddings, books, elections, grandparents. They do not see the medium that made all of it possible.

They do not, most days, ask how’s the water?

The people who do ask the question are the people who have already begun to see it.

The line of witness this project tracks is the line of people who named the water — so the fish could begin to see it.

Smedley Butler in 1935 named the racket by naming the water it was extracted from. Frederick Douglass in 1852 named the water the Fourth of July did not name. John Newton in 1788 named the water the slave trade was defiling. Robert Burns in 1795 named the dignity of the man that the rank had obscured. Katharine Lee Bates in 1893 named the country beside the country’s flaws. Thurgood Marshall in 1954 named the constitutional water in the case that broke the seawall of Plessy. Dwight Eisenhower in 1961 named the apparatus he had built across the water it was displacing. Martin Luther King Jr. in 1967 named the war the Riverside Church congregation could no longer un-see.

Each of these witnesses did what the older fish in the parable did. They asked, in a hundred different registers, How’s the water?

The question is not innocent. The question is the beginning of the seeing.

You are now a fish.

The question is not whether the water is around you. It is. It has been. The medium of ordinary life — the maintained structural arrangements that allow you to read this on a phone or a laptop in a quiet room without artillery in the distance — is around you now.

The question is whether you have started to see it.

The moment the fish asks what the water is, is the moment the fish becomes something more than a fish. The moment the citizen asks what the peace is, is the moment the citizen becomes something more than a beneficiary of it. The moment enough citizens ask the question, is the moment the maintenance of the peace becomes a public act rather than a background condition.

Today is the one hundred fifty-eighth anniversary of the ratification of the Fourteenth Amendment to the Constitution of the United States.

On July 9, 1868, South Carolina and Louisiana became the twenty-eighth and twenty-ninth states to ratify — enough to reach the three-quarters threshold Article V requires. Secretary of State William H. Seward certified the ratification on July 28, 1868.

What preceded it was the largest and costliest war ever fought on this continent.

Approximately seven hundred and fifty thousand Americans died in the Civil War of 1861 to 1865 — a figure revised upward by the demographic historian J. David Hacker in a 2011 study, from the long-standing estimate of approximately six hundred and twenty thousand. Two percent of the entire American population. In today’s proportional terms, approximately seven and a half million dead.

That is the cost the war extracted.

What the war produced structurally is the Thirteenth, Fourteenth, and Fifteenth Amendments. Three amendments in approximately fifty months.

December 6, 1865 — the Thirteenth Amendment is ratified. It abolishes slavery and involuntary servitude except as punishment for crime.

July 9, 1868 — the Fourteenth Amendment is ratified. It establishes birthright citizenship; guarantees privileges and immunities, due process, and equal protection of the laws to all persons; disqualifies from public office those who having taken an oath of allegiance to the Constitution then engaged in insurrection against it; validates the public debt of the United States and repudiates the debts of the Confederacy.

February 3, 1870 — the Fifteenth Amendment is ratified. It prohibits the denial of the right to vote on account of race, color, or previous condition of servitude.

Three amendments in fifty months. This is what the Civil War produced.

This is peace as constitutional architecture.

Not the peace that ended the war — that was Appomattox, April 9, 1865. The peace that came after: the constitutional inscription of what the war had cost, so the next generation would inherit the counter-record without having to fight for it again.

That was the intent.

The honest counter-record within the honest counter-record is that the intent did not hold.

The Slaughter-House Cases in 1873 narrowed the Privileges or Immunities Clause to near-irrelevance. The Civil Rights Cases in 1883 held that the Fourteenth Amendment did not reach private discrimination. Plessy v. Ferguson in 1896 sanctioned racial segregation under the “separate but equal” doctrine. Between 1877 and 1954, the equal-protection promise of the Fourteenth Amendment was substantially unavailable to the persons for whom it had been most specifically written.

Reconstruction did not end on a date. Reconstruction ended over decades, through Supreme Court decisions, state constitutional conventions, Klan violence, disenfranchisement statutes, and a federal will that first weakened, then withdrew. What survived under altered names was Jim Crow — Jim Crow as the political name for the systematic nullification of the very amendment ratified on this day one hundred fifty-eight years ago.

The amendment did not defend itself.

It took another line of witness to restore it.

Ida B. Wells named the lynchings in the 1890s. W.E.B. Du Bois named the color line in 1903. Thurgood Marshall — Chapter Eleven of the volume the newsletter accompanies — argued Brown v. Board of Education before the Supreme Court in 1952 and 1953, using the Fourteenth Amendment as his constitutional foundation. The Court decided May 17, 1954. The Civil Rights Act of 1964 and the Voting Rights Act of 1965 delivered the statutory enforcement the Fourteenth and Fifteenth Amendments had promised in 1868 and 1870.

Martin Luther King Jr. — Chapter Thirteen — delivered the moral witness that made the legislative action possible.

The line of witness is the line that carries the honest counter-record across the generations when the structure does not carry it on its own.

The Fourteenth Amendment continues, present tense, to guarantee equal protection of the laws. What it does today, it does because someone in every generation between 1868 and now decided to insist that the promise be kept. The amendment did not enforce itself. It never will. It is a text on paper. The people who wrote it are dead. The people who ratified it are dead. The people who defended it across the century between 1868 and 1968 are dead.

What is left of it is the promise — and the people who continue to insist that the promise be kept.

That includes you.

Yesterday’s missive named the apparatus. Today’s missive shows what the apparatus produces.

On the afternoon of August 2, 1964, USS Maddox (DD-731), a Sumner-class destroyer conducting a signals-intelligence patrol in international waters in the Gulf of Tonkin, was engaged by three North Vietnamese P-4 torpedo boats. The engagement occurred. There is no dispute about August 2. Maddox fired warning shots, then aimed fire; F-8 Crusaders from USS Ticonderoga joined the action; two of the three P-4 boats were damaged; the Maddox took a single bullet strike to its superstructure. No American was killed. That was the actual engagement.

Two nights later, on August 4, in bad weather, the Maddox and USS Turner Joy (DD-951) reported a second attack.

Captain Herrick was aboard the Maddox. He sent the cable above the same day.

The cable was received in Honolulu and in Washington within hours. President Lyndon Johnson had it. Secretary of Defense Robert McNamara had it. The Joint Chiefs had it. The Senate Foreign Relations Committee did not.

On the evening of August 4, LBJ went on national television and announced retaliatory air strikes against North Vietnamese naval bases and an oil storage facility at Vinh. He did not mention Herrick’s cable.

On August 7, 1964, Congress passed the Southeast Asia Resolution — commonly called the Gulf of Tonkin Resolution — authorizing the President “to take all necessary measures to repel any armed attack against the forces of the United States and to prevent further aggression.”

The Senate vote was 88 to 2. Senators Wayne Morse of Oregon and Ernest Gruening of Alaska cast the two dissenting votes. The House vote was 416 to 0.

Combined: 504 to 2.

The resolution was the legal foundation for the full expansion of the Vietnam War.

By April 1969, U.S. troops in Vietnam peaked at approximately 549,500. By the fall of Saigon on April 30, 1975, approximately 58,220 American servicemen were dead. The Vietnamese, Cambodian, and Laotian dead across the wider conflict number in the millions — scholarly estimates commonly place total Vietnamese dead at two to three million, with additional heavy losses across Cambodia and Laos.

The August 4 attack did not happen.

This was not established in 1965 or 1975 or 1985. This was established inside the National Security Agency itself.

In 2000 and 2001, an NSA historian named Robert J. Hanyok completed a study titled Skunks, Bogies, Silent Hounds, and the Flying Fish: The Gulf of Tonkin Mystery, 2–4 August 1964. Hanyok reviewed the signals intelligence available on and after August 4, 1964. He concluded that the SIGINT reports supporting the second attack had been selected, translated, and presented in a manner that produced a false picture. Some intercepts had been misdated. Some had been mistranslated. The intercepts that would have contradicted the second-attack narrative had not been forwarded to decision-makers.

Hanyok’s conclusion, in his own sentence:

The overwhelming body of reports, if used, would have told the story that no attack had happened.

The Hanyok study was completed inside the NSA. It sat classified for approximately four years. It was declassified and publicly released on November 30, 2005, forty-one years after Herrick’s cable, under pressure from historians and the National Security Archive at George Washington University.

Secretary McNamara, interviewed by Errol Morris for The Fog of War in 2003, delivered the shortest version of the finding:

It didn’t happen.

The structural point is not that Johnson lied. That is a small point. The structural point is that the apparatus did not require a lie. The apparatus required only that a doubted report be treated as sufficient grounds. The commander on the destroyer being “attacked” cabled the same day that the attack was doubtful. The apparatus voted 504 to 2 to authorize the war anyway. The archives, the intercepts, the internal doubts — all of it stayed inside the classified system for forty-one years while the war was fought, lost, and grieved.

This is the line of witness the volume the newsletter accompanies is tracking. Butler in 1935: War is a racket. It always has been. It is possibly the oldest, easily the most profitable, surely the most vicious. It is the only one international in scope. It is the only one in which the profits are reckoned in dollars and the losses in lives. Butler was writing about the Spanish–American War and the First World War. He was describing, sixty years early, the same structural move that would produce the Southeast Asia Resolution on August 7, 1964.

The apparatus is patient. The apparatus is old.

The honest counter-record — that Herrick doubted the report the same day, that Hanyok said so in NSA’s own voice thirty-six years later, that McNamara said it didn’t happen on camera in 2003 — is the record we hold now. It was held inside the classified system while the consequence was being paid outside it.

Tonight is a good night to sit with that.

The United States is now more than two hundred and fifty years old. The Semiquincentennial. Ten generations and change since Jefferson and Adams and Franklin gathered with the others in Philadelphia and signed the document that began it.

I remember the Bicentennial. I was in third grade. We lived in New Haven, and that summer my parents drove me to the places where the country had begun. We touched the Liberty Bell — visitors were allowed to, then. We stood in Independence Hall where the Declaration was signed. My mother had been born in Philadelphia, first-generation American, and she had not seen those rooms herself until that summer either.

We drove to Plymouth Rock and learned it was not actually where the Pilgrims had first landed. We walked through Sturbridge Village watching the coopers and blacksmiths work the way the colony had worked. We rode through the Vermont mountains. The country was two hundred years old that summer. To a third-grader being shown it for the first time, it felt new. Awesome in the mind of an eight year-old.

The country is fifty years older now. And the country has built, in the half-century since I touched the bell, the most expensive war-making apparatus in human history.

The iron triangle is not a metaphor. It is a procurement strategy.

The F-35 fighter jet is the canonical American example. Final assembly is in Fort Worth, Texas. The engine is built by Pratt & Whitney in Connecticut — the state I was a third-grader in. The supply chain reaches more than 1,800 subcontractors across forty-five of the fifty states.

This was not an accident of where the right factories happened to be. It was the program's design.

When the F-35 hit its long string of cost overruns — the program's lifetime cost is now estimated at roughly 1.7 trillion dollars through 2070, making it the most expensive weapons system in human history — Congress did not cancel it. Congress could not cancel it. Each cancellation vote would have closed factories in dozens of states whose senators and representatives sit on the committees that fund the program. The same logic protects the M1 Abrams tank line in Lima, Ohio that the Army has at times told Congress it does not need. The same logic protects bases in districts whose representatives sit on the Armed Services committees.

This is what the pull quote means. The wars come not because anyone wills them at the start. They come because at every step the cost of stopping — the closed factories, the unemployed constituents, the canceled contracts — is higher than the cost of continuing.

The iron triangle is the contractor, the congressional committee, and the Pentagon, each acting rationally inside the structure the structure has built for each.

No conspiracy is required. The system is the conspiracy.

The third-grader who touched the Liberty Bell did not know about Fort Worth. He did not know that Pratt & Whitney, in the state where he lived, would build the engine of the most expensive weapon in human history. He did not know about Lima, Ohio.

The republic was supposed to be one in which the citizens decided whether to fight. Independence Day exists to honor that decision. The Iron Triangle is what has been built where that decision used to live.

Eighty-four years ago today, on the morning of Monday, July 6, 1942, the Frank family climbed the stairs of an Amsterdam canal house at Prinsengracht 263 and disappeared into the back rooms above Otto Frank’s pectin business.

The day before, Anne’s sister Margot, sixteen years old, had received a written call-up notice from the Central Office for Jewish Emigration ordering her to report for transport to a German forced-labor camp. Otto Frank had been preparing the hiding place quietly across the preceding months — supplies stocked, beds arranged, the entrance to be concealed behind a movable bookcase Otto’s trusted employees would mount over the doorway. Anne was thirteen years old. The family entered the Annex with what they could carry, walked the early-morning streets to avoid notice, and arrived at the back stairs of the canal house. They would not leave for twenty-five months.

Anne had received a diary three weeks earlier, on her thirteenth birthday — June 12, 1942. A red-and-cream checkered cloth-bound autograph album, of the kind sold for schoolgirls’ birthday gifts. She named it Kitty and addressed her entries to it as letters to a friend. She began writing in it on June 14. She continued writing through twenty-five months of hiding. The last entry is dated August 1, 1944. Three days later the apparatus the family had been hiding from arrived at the canal house and arrested all eight residents — the Franks, the van Pels family, and the dentist Fritz Pfeffer who had joined them in November 1942.

The Achterhuis — the back house, the Secret Annex the diary’s English title would later make familiar to readers around the world — was approximately five hundred square feet across two narrow floors. Eight people for twenty-five months. A converted office. Furniture from Otto’s living quarters. A bathroom they could use only when the workers in the business below could not hear. Curtains drawn permanently. Outside footsteps audible. The radio always at low volume. Days organized around the silence the hiding required.

This is where the diary was written.

The diary is one of the most-read books of the twentieth century. It has been translated into more than seventy languages. The building at Prinsengracht 263 receives over a million visitors a year. The line In spite of everything I still believe that people are really good at heart, written by a fifteen-year-old girl three weeks before her arrest, is among the most quoted sentences ever composed in any language. It has been quoted at confirmations and graduations and funerals; at the openings of monuments and museums; at memorial services and political speeches and family dinners — sometimes accurately, sometimes naively, often without enough attention to what it cost the writer to compose it.

The line is not naive optimism. The line is the peace-witness signature move at its purest. It is the simultaneous holding of two facts that should logically cancel each other: the apparatus has decided to murder this writer, and the writer has decided that the apparatus does not get to determine what she believes about the people the apparatus is comprised of. The structural fact and the moral claim, both held at the same moment, neither denying the other. This is what the Peace Racket line of witness has been doing across every chapter the volume tracks. Smith in 1759 holds the structural reality of self-interest alongside the moral foundation that makes commerce livable. Douglass in 1852 holds the Founders’ work alongside the cost of slavery. Eisenhower in 1961 holds the apparatus he built alongside the warning against it. King in 1967 holds the prophetic register alongside the institutional cost the apparatus would extract from him within twelve months. Anne Frank in 1944, on a Saturday afternoon in the Annex, holds the catastrophe alongside the belief. Same move, different register.

She and Martin Luther King Jr. were born in the same year.

Anne on June 12, 1929 in Frankfurt am Main. King on January 15, 1929 in Atlanta. They were exact contemporaries. In the summer of 1942 — Anne climbing the stairs to the Annex — King was thirteen years old, reading in his grandfather’s library on Auburn Avenue and skipping grades at Booker T. Washington High School. The line of witness this volume tracks closes at King’s death in Memphis in April of 1968. Anne Frank stands beside him as the parallel witness the line implicitly calls for — the witness from inside the catastrophe rather than from outside-but-inside the segregation regime, but the same witness across the same generation, with the same simultaneous holding the witness requires.

She was murdered at Bergen-Belsen concentration camp in late February or early March 1945, at fifteen years and approximately eight months old. The exact date is unknown. The exact place she was buried is unknown. The only member of the Annex who survived was Otto Frank. He returned to Amsterdam in June 1945 and was given Anne’s diary by Miep Gies, the secretary who had retrieved it from the floor of the Annex after the arrest and kept it unread for eleven months in hope the family would return to read it. Otto read it. He arranged for its publication. Het Achterhuis appeared in Amsterdam in 1947, in a first print run of fifteen hundred copies.

Eighty-four years ago today the family climbed the stairs.

The diary is on the desk in the back room where she wrote it. The house at Prinsengracht 263 is open to visitors via the Anne Frank House, which maintains the museum and an extensive free public archive of Anne's life and the diary's history.

The peace witness this volume tracks includes the public-square witnesses — Butler’s pamphlet, Eisenhower’s televised address, King’s pulpit, Douglass at Corinthian Hall — and includes the private witnesses whose testimony became public because the witness demanded it. Yesterday America celebrated two hundred and fifty years of the Republic. Today is the one hundred and seventy-fourth anniversary of one of the most consequential addresses ever delivered on this continent.

Frederick Douglass stepped to the platform at Corinthian Hall in Rochester, New York on Monday, July 5, 1852, to speak to approximately six hundred members of the Rochester Ladies’ Anti-Slavery Society and their guests. He had been invited to give the Independence Day oration. He had taken the date as offered — July 5th — and delivered an address that, in its honest pairing of acknowledgment and counter-record, has stood for one hundred seventy-four years as the founding document of the American honest-counter-record genre.

He was thirty-four years old. He had been a free man for fourteen years. He had escaped slavery from the Eastern Shore of Maryland on September 3, 1838 at approximately twenty years old. He had been speaking publicly for the abolitionist cause since 1841. He had published the Narrative of the Life of Frederick Douglass, an American Slave in 1845. He had founded The North Star in Rochester in 1847. He had lived in Rochester since.

He had also, every July 4 for the previous fourteen Independence Days, watched the country celebrate a liberty no enslaved Black American held.

The address ran approximately ninety minutes and approximately ten thousand words. The structure of the address was deliberate.

The first half acknowledged the Founders’ work in the highest register American political-rhetorical tradition could produce. Douglass praised the signers of the Declaration. He praised their courage. He praised the Revolution as a structural break with the institutional configuration of monarchy that had preceded it. He praised the political-philosophical inheritance the Declaration had codified. He gave the Fourth of July, on its own terms, the full honor an American citizen could give it.

And then he pivoted.

He named the contradiction. He named the enslaved — approximately three and a half million human beings held in bondage by the same Republic the Declaration had inaugurated. He named the structural cost the Republic was extracting from the bodies of those held in slavery, every day, in every state of the Union where slavery was the institutional form. He named, in plain American English, what the Independence Day celebration did not name.

“What, to the American slave, is your 4th of July?” he asked the audience. “I answer; a day that reveals to him, more than all other days in the year, the gross injustice and cruelty to which he is the constant victim. To him, your celebration is a sham... There is not a nation on the earth guilty of practices, more shocking and bloody, than are the people of these United States, at this very hour.”

He delivered the diagnosis. He delivered the receipts. He named the cost the celebration was not naming.

“This Fourth July is yours, not mine. You may rejoice, I must mourn.”

The address has been studied for one hundred seventy-four years as a model of public-square rhetoric in the prophetic-political register. What the line of witness this project tracks recognizes in it is the structural move the address made.

Douglass did not refuse the Republic. He did not dismiss the Founders. He did not name the celebration as illegitimate. He named the celebration as honest only when it told the whole truth — the Founders’ work AND the cost of slavery, the Declaration AND the chains, the political-philosophical accomplishment AND the human beings still held in the antebellum South. He held both at once. He did not let the country off the structural argument by withdrawing from the celebration. He stayed in the conversation. He insisted on the honest counter-record.

This is the line-of-witness move at its highest register.

Smith named the moral foundation under the political economy in 1759 and 1776. Newton named the slave trade as wrong in 1788 from inside his own former participation in it. Burns named the dignity of the man under the rank in 1795. Bates named the country’s flaws beside the country’s beauty in 1893. Butler named the racket beside his own thirty-three years of Marine service in 1935. Eisenhower named the apparatus he had built across his Farewell of 1961. King named the war African-American servicemen were fighting at higher proportions than white servicemen across his Riverside Church address of 1967.

Each of these witnesses delivered the structural diagnosis from inside the institution they were diagnosing.

Douglass delivered the structural diagnosis from inside the body the institution had specifically inflicted itself on.

He died at home in Washington, D.C. on February 20, 1895, at approximately seventy-seven. He had been a Republican Party loyalist across the postwar decades. He had served as Marshal of the District of Columbia under Hayes, Recorder of Deeds for the District under Garfield and Arthur, and Minister Resident and Consul General to Haiti under Harrison. He had outlived emancipation by thirty years, Reconstruction by eighteen, and most of his original antislavery comrades by varying intervals. He had continued the public witness across all of it.

The address he delivered on July 5, 1852 has been published in pamphlets, anthologies, schoolbooks, and scholarly editions for one hundred seventy-four years. It is in the public domain. You can read the entire address tonight in approximately one hour.

Tonight across the country, fireworks will explode in time with Tchaikovsky’s 1812 Overture. The 1812 in the title is not the American 1812.

Two hundred and fifty years today.

Across the country tonight, in towns and cities the founders never heard of, on lawns and rooftops and beaches and parks, citizens will look up at the sky as orange and gold and white explosions bloom against the dark. Many of those displays will be choreographed to music. Many of those will use, at the climax, Pyotr Ilyich Tchaikovsky’s Festival Overture, the Year 1812 — the piece you know as the 1812 Overture, the one with the cannons.

It is the most American piece of music played in America that has nothing whatsoever to do with America.

Tchaikovsky composed it in 1880. He was forty years old, world-famous, and had accepted a commission from Nikolai Rubinstein to write a piece for the Moscow Arts and Industry Exhibition. The exhibition was timed to commemorate, among other things, the Russian Empire’s victorious defense against Napoleon Bonaparte’s invasion of 1812.

The 1812 in the title is the Russian 1812. Borodino. The burning of Moscow. The disastrous French retreat in winter. The line that broke Napoleon and started the chain of events that would put him on St. Helena three years later.

The piece is structured as a musical narrative of that campaign. It opens with the Russian Orthodox hymn O Lord, Save Thy People. It builds through battle motifs. It quotes the French Marseillaise — the revolutionary anthem — at the moment Napoleon’s forces are advancing. As the music turns, the Marseillaise is musically defeated. The climax delivers God Save the Tsar, the Imperial Russian anthem, triumphant over cannon fire that Tchaikovsky wrote into the score and over the toll of church bells he wrote in beside the cannons.

The piece, in other words, dramatizes the autocratic Russian monarchy defeating French revolutionary forces. It does this with literal cannons and literal church bells.

Tchaikovsky himself did not think much of it.

In a letter to his patron Nadezhda von Meck in October 1880, he described the piece as “very loud and noisy” and written “without warmth or love,” and predicted it would have “no artistic merit.” He was not exaggerating his own assessment. The piece was commissioned, written quickly, scored loud, and intended for outdoor performance with cannons and church bells at the 1882 Moscow exhibition.

It became one of the most performed pieces in the entire orchestral repertoire.

The American connection arrived ninety-four years later.

Arthur Fiedler, the conductor of the Boston Pops, was looking for a piece that would crown the Pops’ annual July 4 concert on the Charles River Esplanade in 1974 — the run-up to the 1976 Bicentennial. He chose the 1812 Overture. He arranged for real cannon fire from the Massachusetts National Guard’s 21st Regiment Artillery Group. He arranged for fireworks above the Esplanade choreographed to the music. The concert was televised. It became standard repertoire from there.

Today the 1812 Overture is so embedded in American Independence Day celebration that most Americans do not know what 1812 the title refers to, or whose victory the music celebrates, or that the cannons in the fireworks are echoing the cannons Tchaikovsky wrote to depict the cannons of Borodino fired by a Russian Imperial army that no longer exists in defense of a Russian Imperial monarchy that fell in 1917.

We celebrate American independence from a British monarchy with a piece of music that dramatizes a Russian monarchy defeating French revolutionary forces.

This is not a small irony.

Peace Racket would note: this is what happens when spectacle absorbs substance into atmosphere. The cannons are loud. The cannons are beautiful. The cannons demand nothing of the listener except awe at the cannons. The peace witness asks what the music is saying — and whether the citizen, set on quietly listening for the substance under the spectacle, is being underserved by the spectacle.

The line of witness has its own songs.

Amazing Grace. John Newton, written approximately 1772, sung the world over — no cannons, no Tsars, no defeated enemies. America the Beautiful. Katharine Lee Bates, drafted at the summit of Pikes Peak in 1893 — no cannons, no military victory, only the petition God mend thine every flaw, confirm thy soul in self-control, thy liberty in law. James Weldon Johnson, 1900 — the song the line of witness sings while it waits for the day true freedom comes. The spirituals — We Shall Overcome, Free at Last, Steal Away — sung from inside the catastrophes the apparatus produced, persistent across the centuries no autocracy could silence.

These songs are not loud. They do not have cannons. They are the songs the line of witness sings while the fireworks go off above the cannons of a Russian piece commemorating a Russian monarchy that no longer exists.

Tonight the fireworks will explode. Tomorrow the line of witness will continue.
